תנאי שימוש

ברוכים הבאים לאתר של מכון דבורה (ע"ר) להלן – "העמותה" בכתובת Dvora-institute.org (להלן: "האתר"). העמותה שמה לה למטרה לקדם זכויות נשים ולתעד ולחקור את פשעי חמאס ב 7.10 נגד נשים וילדים.

1. הסכמה :

בבקשה קרא/י את תנאי השימוש ומדיניות הפרטיות (לינק) והימנע/י משימוש באתרי ו/או בשירותים המוצעים על ידי העמותה במידה ואינך מסכים/מה להם.
קריאת תכני האתר וכן כל שימוש שתעשה/י באתר ובשירותי העמותה מהווה הסכמתך המלאה לכל תנאי השימוש שלהלן ולמדינות הפרטיות של העמותה (לינק), המהווה חלק בלתי נפרד מתנאי השימוש.
מובהר כי תנאי השימוש חלים בין אם הינך גולש/ת לאתר העמותה, לדף הפייסבוק שלה, בין אם באמצעות מחשבך ובין אם באמצעות אפליקציה ו/או בטלפון הנייד האישי וכיו"ב. במידה והנך קטין/ה, מתחת לגיל 18, הימנע/י משימוש באתר.

2. בעלות וזכויות יוצרים:

כל זכויות הקניין הרוחני, לרבות זכויות היוצרים בחומרים ובתכנים המופיעים באתר זה (כגון: יצירות, טקסט, גרפיקה, סמלים, תמונות, סרטונים, מכתבים, מאמרים, ניירות עמדה וכיו"ב, להלן – "התכנים") הינן בבעלות העמותה ו/או בבעלות צדדים שלישיים אחרים אשר העניקו לעמותה רשות לעשות שימוש בהם.
השימוש באתר ו/או בתכנים נועד אך ורק לשימוש אישי ופרטי של המשתמש וחל איסור מוחלט לעשות בהם שימוש אחר כלשהו, לרבות כל שימוש מסחרי ו/או ציבורי ו/או סיטונאי כלשהו.
המשתמש רשאי לעשות על אחריותו הבלעדית "שימוש הוגן" בתכנים ובאתר, לצרכי לימוד עצמי, ו/או לצרכי הוראה ומחקר בידי משתמש שהינו מוסד חינוך, בכפוף לכללים הקבועים בדין. אולם, אין לפרש תנאי כלשהו מתנאי שימוש אלו כמעניק למשתמש רשיון שימוש או הסכמה כלשהם לעשות שימוש בתכנים, במפורש או במשתמע.
בכפוף לשימוש הוגן על פי דיני זכויות יוצרים כאמור, אין להעתיק, להפיץ, לשדר, להציג, לשכפל, לפרסם, לצלם, לערוך, להעמיד לרשות הציבור, למכור ו/או לעשות שימוש אחר כלשהו באתר ו/או בכל חלק או מרכיב בו ו/או בתכנים, אלא בהסכמת העמותה מראש ובכתב. אין לעשות בתכנים כל סילוף, פגימה או שינוי אחר, או כל פעולה שיש בה משום הפחתת ערך ביחס לתוכן המוגן, העלולה לפגוע בכבודו או בשמו של בעל זכויות היוצרים בו ויש לתת קרדיט לבעל הזכויות ולציין את המקור.

3. השימוש באתר

השימוש באתר והצפייה בתכנים המתפרסמים בו מותרים למטרות שאינן מסחריות, ואינם כרוכים ברישום מוקדם. אין להשתמש באתר –

באופן המהווה או העלול להוות עבירה פלילית או עוולה אזרחית בהתאם להוראות כל דין, או הפוגע בזכויותיו של צד שלישי כלשהו;
באופן הפוגע או העלול לפגוע בעמותה, במשתמשים אחרים של האתר, או בגופים הקשורים לעמותה;
כדי לנסות לפגוע באבטחת המידע באתר, לנסות לזהות חולשות באבטחת המידע של האתר, או לנסות לבצע כל צורה של בדיקה, סריקה, איסוף נתונים, אחזור מידע, כריית מידע, ניווט רובוטי או פריצה לאתר;

4. קישורים לאתרים אחרים:

באתר זה קיימים קישורים לאתרים מחוץ לאתר העמותה. קישורים אלה ניתנים מטעמי נוחות. האתרים המקושרים אינם תחת שליטה של העמותה והיא אינה אחראית לתכנים של כל אתר מקושר או כל קישור הכלול באתר מקושר, או לכל שינויים או עדכונים לאתרים כאלה, והיא אינה אחראית לכל נזק שעשוי להיגרם עקב הפניה לאתרים אלה ו/או עקב הסתמכות על תוכניהם. כל מידע או פעילות שתעשה באתרים אלו הינם באחריות אותם אתרים ובאחריות המשתמש/ת עצמו/ה ויש לקרוא באתרים אלה את תנאי השימוש ומדיניות הפרטיות שלהם, לפני הגלישה והשימוש בהם.

5. תכני האתר והגבלת אחריות:

המידע והתכנים באתר מועברים AS-IS (כפי שהם). התכנים הינם אינפורמטיביים בלבד, ולא נועדו לשמש ייעוץ מקצועי, משפטי או אחר. למרות שהעמותה עושה מאמצים לספק תוכן מדויק ואמין, היא לא תישא באחריות לכל נזק שעלול להתרחש כתוצאה מהסתמכות המשתמש על התכנים המתפרסמים באתר.
העמותה תהא רשאית לשנות על פי שיקול דעתה הבלעדי, את עיצובו של האתר ו/או מבנהו ו/או תכניו ו/או להפסיק בכל עת את מתן השירותים באתר, חלקם או כולם, ו/או כל היבט אחר באתר. המשתמש/ת מוותר/ת בזאת על כל טענה ו/או דרישה בהקשר זה.
בעצם השימוש באתר ו/או בשירותי העמותה המשתמש/ת מסכים/מה לכך כי העמותה, תורמיה ו/או מי מטעמה לא יישאו באחריות לכל נזק, הוצאה, הפסד, אבדן, או פגיעה ישירים ו/או עקיפים מכל סוג שהוא, שייגרמו למשתמש כתוצאה משימוש ו/או מהסתמכות על התכנים והשירותים המוצעים באתר ו/או אשר נמסרו למשתמש ע"י העמותה, והנך מוותר/ת בזאת על כל טענה או דרישה כאמור כלפי כל הגורמים אשר צויינו לעיל ופוטר אותם מכל אחריות כאמור.
למשתמש/ת לא תהיה כל טענה בגין אבדן נתונים ו/או תוכנות שהיו ברשותו ו/או בגין הפרעות במהלך השימוש באתר.

פרטיותך חשובה לנו. מדינות הפרטיות (לינק) של האתר מהווה חלק בלתי נפרד מתנאי השימוש, ועלייך לעיין בה.

7. שינויים בתנאי השימוש ומדיניות פרטיות:

העמותה רשאית לשנות מעת לעת את הוראות תנאי השימוש ומדיניות הפרטיות. אם יבוצעו שינויים מהותיים, לרבות, בהוראות שעניינן השימוש במידע שמסרת, תפורסם על-כך הודעה באתר.

8. הדין החל ופרטים ליצירת קשר:

בכל שאלה או פנייה לעמותה בנושא תנאי השימוש ומדיניות הפרטיות ומאגר מידע הנך רשאי לפנות למכון דבורה דוא"ל info@dvora-institute.org
על אתר זה יחולו לכל דבר ועניין דיני מדינת ישראל בלבד. מקום השיפוט הבלעדי בגין כל דבר ועניין הנובע והכרוך בשימוש באתר זה באופן ישיר או עקיף, יהא בבתי משפט המוסמכים במחוז ירושלים.

מדיניות פרטיות

מכון דבורה (ע"ר) (להלן – "העמותה") רואה חשיבות עליונה, הן כערך בפני עצמו והן מכח החוק, בשמירת פרטיותך. מדיניות פרטיות זו נועדה ללמד אותך על האופן שבו העמותה משתמשת במידע האישי שלך, שהיא אוספת בעת שימושך באתר האינטרנט שלה שכתובתו dvora-institute.org (“האתר”). בעצם השימוש באתר הינך מסכים למדיניות פרטיות זו, המהווה חלק בלתי נפרד מתנאי שימוש באתר (לינק).

1. מידע שנאסף ישירות ממך:

1.1 יצירת קשר עם העמותה - בעת פנייה לעמותה באמצעות הדוא”ל או באמצעות טופס הפנייה המקוון באתר, אנו אוספים את שמך המלא, מספר הטלפון שלך, כתובת הדוא”ל שלך ואת תוכן פנייתך. בעצם פנייתך הנך נותן הסכמתך מראש לחזור אליך, ולכך שתוכן פנייתך ישמר במערכת ניהול פניות של העמותה. אנו ממליצים להזין רק את הפרטים החיוניים לצורך פנייתך; אולם, ככל שתבחר להזין פרטי מידע אישי אודותיך, בחלונית "המלל החופשי" או בדוא"ל, הנך מסכים לאיסוף ולעיבוד שלנו ולשימוש במידע האישי שיוזן בהתאם למדיניות פרטיות זו. אם אינך מסכים לעיבוד ולשימוש כאמור, הנך מתבקש שלא למסור או לשתף איתנו מידע שכזה.

1.2 מסירת עדות וחומרים בקשר עם מאורעות השבעה באוקטובר– אם ברצונך למסור עדותך, לחלוק מידע או לשתף חומרים שברשותך, בקשר עם מאורעות השבעה באוקטובר, אנא צור קשר עימנו באמצעות דוא"ל המפורסם באתר. כאמור לעיל, אנו ממליצים להזין רק את הפרטים החיוניים לצורך פנייתך ללא מידע אישי. אנו ניצור עמך קשר בהקדם לצורך כך וככל שתחליט למסור לנו עדות ולהשתתף באחד ממיזמי התיעוד שלנו, הדבר יהיה כפוף להסכמתך וחתימתך על כתב הסכמה נפרד אשר יפרט את השימושים שיעשו במידע ו/או בחומרים שמסר לנו.

1.3 תרומה לעמותה –

באפשרותך לתרום לעמותה, לפי שיקול דעתך, על מנת לסייע לנו להמשיך בפעילותנו.

תרומתך יכולה להיות חד פעמית או קבועה (חודשית או שנתית), בסכום ובמטבע לבחירתך, באמצעות קישור לטופס מאובטח. לחלופין, ניתן לתרום העברה בנקאית והמחאות לכתובות המוצגות בעמוד התרומה שבאתר.

אם הנך מבצע תרומה באמצעות כרטיס אשראי, תועבר לאתר של JFC / JGIVE ושם תידרש למסור את שמך המלא, את מספר הטלפון, כתובת המגורים וכתובת הדוא”ל שלך, את פרטי אמצעי התשלום שלך ואת סכום ותדירות התרומה. מובהר כי פרטים אלו אינם נמסרים ו/או נשמרים אצל העמותה אלא אצל הסולק בהתאם למדיניות הפרטיות שלו המפורסמת באתרו.

1.4 לידעתך, הרישום לקבלת עדכונים, וכן הפנייה אלינו באמצעות דוא”ל או הטופס המקוון באתר, מהווים, כל אחד מהם כשלעצמו, הסכמתך המפורשת לקבלת הודעות טקסט (SMS) ודוא”ל מהעמותה או מי מטעמה, כנדרש בהוראות סעיף 30א לחוק התקשורת (בזק ושידורים), התשמ”ב-1982.

העמותה תשלח לך מעת לעת, באופן ישיר או באמצעות ספקי השירותים שלה, מידע ותוכן פרסומי אל מספר הטלפון ו/או כתובת הדוא”ל שמסרת לנו במהלך הרישום לקבלת עידכונים, מתן התרומה לעמותה, או הפנייה אלינו.הנך רשאי לפנות אל העמותה, בכל עת, באמצעות דוא"ל בכתובת: info@dvora-institute.org ולדרוש הסרתך מרשימת הדיוור והפסקת השירות.

1.5 פניה דרך רשתות חברתיות - ככל שתפנה אלינו באמצעות עמודי הרשתות החברתיות שלנו יתכן שנאסוף עליך את פרטי המידע הבאים: שם מלא, פרטי קשר כגון מספר טלפון או כתובת דואר אלקטרוני, תוכן הפניה וכל מידע אישי אחר אודותיך שתבחר למסור לנו במסגרת פנייתך.

דע/י כי אין לך כל חובה חוקית למסור את פרטייך לעיל אלא בהסכמתך, ואולם, אם בחרת למסור את הפרטים, עליהם להיות נכונים, מדויקים ומלאים. מסירת פרטים שגויים עלולה למנוע ממך את האפשרות להשתמש באתר כנדרש, ולמנוע מאיתנו ליצור אתך קשר, ולענות על פנייתך.

2. מידע שנאסף במהלך שימושך באתר:

באתר נעשה שימוש בכלים של צדדים שלישיים כדי לאסוף ולנתח מידע סטטיסטי ואנונימי – שאינה מזהה אותך באופן אישי – בנוגע לשימושך באתר. במהלך גלישתך באתר נאספים הפרטים הבאים:

מידע על המחשב שלך, כולל כתובת ה-IP שלך, סוג הדפדפן והגרסה שלו, ומערכת ההפעלה;

ניהול האתר שלנו ולאפשר לכם להשתמש בשירותים הזמינים באתר שלנו;

לצורך ניתוח, בקרה ומסירת מידע סטטיסטי לצדדים שלישיים. מידע זה לא יזהה אותך באופן אישי;

לכל מטרה אחרת, המפורטת במדיניות זו ו/או בתנאי השימוש של האתר.

כדי לשלוח לך מדי פעם, עדכונים, בדואר אלקטרוני או בהודעת טקסט (SMS) מידע בדבר פעילותה של העמותה, בקשות לתרומות וכל מידע פרסומי אחר (אתה יכול להודיע לנו בכל עת שכבר אין לך צורך בשליחת העדכונים);

כדי ליצור איתך קשר כאשר יש בכך צורך, או בעקבות פנייתך אלינו;

4. העברת מידע לצדדים שלישיים

אנו לא נעביר את המידע האישי שלך לצדדים שלישיים ללא הסכמתך המפורשת לכך, אלא במקרים הבאים:

לצורך עמידה בהוראות חוק או דרישות מטעם רשויות מוסמכות. אנו עשויים להעביר מידע על אודותיך, על פי חובה או סמכות שבדין, בהתאם להוראות רשות מוסמכת או צו שיפוטי או בהתאם לכל דין.

ספקי שירות חיצוניים. אנו עשויים לשתף מידע אודותיך עם ספקי שירות חיצוניים המסייעים לנו בניהול פעילותנו, כגון: ספקי מערכות טכנולוגיית מידע(IT) , ספקי סליקה לצרכי ביצוע תרומות, ספקי שירותי תמיכה ואחסון (לרבות באמצעות מחשוב ענן), ספקי שירותי ניתוח מידע ומשלוח תוכן פרסומי, יועצים שונים ושירותים נוספים במיקור חוץ. ספקים אלה מקבלים גישה למידע אך ורק למטרות ביצוע השירותים שלהם עבורנו.

במקרה של מחלוקות ו/או הליכים משפטיים בינך לבין העמותה.

לגופים הקשורים לעמותה או שפועלים בשיתוף פעולה עם העמותה, ובלבד שישתמשו במידע רק בהתאם להוראות מדיניות זו.

במקרה נשנה את המבנה המשפטי שלנו, נעביר לגורמים הרלוונטיים העתק מן המידע האישי שלך שנאגר במאגר המידע שלנו, ובלבד שיפעלו בהתאם להוראות מדיניות זו.

לצרכי מיזמי עדות תיעוד – בהתאם למדיניות זו ולתנאים בכתב ההסכמה עליו חתמת.

5. לידיעתך:

הנך זכאי לעיין במידע שנאסף ומוחזק על ידי העמותה בהתאם למדיניות פרטיות זו על-פי חוק הגנת הפרטיות, התשמ"א -1981 (להלן: "חוק הגנת הפרטיות"). בנוסף, הנך זכאי על-פי חוק הגנת הפרטיות, לדרוש בכתב שהמידע המתייחס אליך יתוקן /או יימחק ממאגר המידע, בכפוף לדין. לתשומת ליבך, יתכן שזכותך לגישה, מחיקה ו/או לתיקון כאמור לעיל, תהיה מוגבלת. אם לא נוכל לקבל את בקשתך, נודיע לך על כך באופן ובדרך שנקבעו בחוק.

6. "עוגיות" (Cookies):

"עוגיה" היא מידע המושתל באופן אוטומטי בדיסק הקשיח של המחשב שלך כאשר אתה גולש באתרי אינטרנט מסוימים. עוגיה זו מסוגלת לזהות באופן ייחודי את הדפדפן שלך בפני השרת.

Welcome to the website of the Dvora Institute (R.A.) (hereinafter: “the Amuta”) at Dvora-institute.org (hereinafter: the “Site”). The Amuta’s purpose is to promote the rights of women and to document and research the crimes of Hamas against women and children on October 7.

1. Agreement:

Please read the Terms of Use and Privacy Policy (link) and refrain from using the Site and/or the services offered by the Amuta if you do not agree to them.
Reading the contents of the Site and any use you make of the Site and of the Amuta’s services constitute your complete agreement to the following Terms of Use and to the Amuta’s Privacy Policy (link), which are an integral part hereof.
The Terms of Use apply, whether you enter the Amuta’s Site or its Facebook page, whether via your computer or an application or your personal phone, etc. If you are a minor (under the age of 18), do not use the Site.

Any information or activities done on such sites are at the sole responsibility of the said sites and of the users, themselves, and one should read the terms of use and privacy policies of such sites, before surfing on them and using them.

The information and Content on the site are provided AS-IS. The Content is informative only, and is not meant to be used for professional consultation, whether legal or otherwise. While the Amuta makes efforts to provide accurate and trustworthy content, it is not responsible for any damage which might be caused as a result of reliance by the user on content published on the Site.
The Amuta may, at its sole discretion, change the design and/or the structure and/or the contents of the Site and/or to cease providing the services and/or any other aspect of the Site, in part or in whole, at any time, and the user hereby waives any claims and/or demands in this regard.

Dvora Institute (R.A.) (hereinafter: “the Amuta”) attaches the highest importance, both as a value in and of itself and pursuant to the law, in protecting your privacy. 1. Information collected directly from you:

1.1 Contacting the Amuta – when you turn to the Amuta via email or the online form on the Site, we collect your full name, your phone number, your email address and the content of what you write to us. By writing to us you are agreeing in advance to our getting back to you, and to our saving the above details in our system. We recommend you only submit details that are important to what you want to tell us; however, to the extent that you submit personal details about yourself in the “free text” window, or in your email, you are agreeing to our collecting, processing and using the personal information, according to the terms of this policy. 1.2 Providing testimony and materials connected to the events of October 7 – if you wish to provide testimony, or to share information or materials in your possession regarding the events of October 7, please contact us via the email address provided on the site. As stated above, we recommend you only submit the details needed for your turning to us, and not additional personal information. We will contact you soon for this purpose, and to the extent you decide to provide testimony and to participate in one of our documentation projects, it will be subject to your agreement and signing on a separate agreement which will detail the uses that may be used of your information and/or of the materials you submit.

1.3 Donations to the Amuta – you may contribute to the Amuta, as you like, in order to assist us in continuing our work. You may make a one-time or an ongoing donation (monthly or yearly), in amounts and in currencies you choose, by way of a link to a secure form. Alternatively, you may transfer funds or send checks to the addresses provided on the donations page of the Site.

If you donate via a credit card, you will be forwarded to the JFC/JGIVE site, and there you will be asked to provide your full name, phone number, residential address and email address, the details of your payment method, as well as the amount and frequency of your donation. Please note that these details are not provided to or maintained by the Amuta, but rather by the payment clearing site, pursuant to its privacy policy.

1.4 For your information- each of registration to receive updates and turning to us via email or the online form on the Site, constitutes your explicit agreement to receive text messages (SMS) and emails from the Amuta or those acting on its behalf, as required pursuant to section 30A of the Israeli Law of Communications (Telephony and Broadcasts), 5742-1982.

The Amuta may send you, from time to time, either directly or via a service provider, information and publicity materials, to the phone number or email address that you provide during registration for updates, in making a contribution, or turning to us. You may turn to the Amuta at any time via email at info@dvora-institute.org and ask to be removed from the mailing list and to discontinue the services.

1.5 Turning to us via social media – should you turn to us via our social media pages, we may collect the following information about you: full name, contact details such as telephone number or email address, the contents of what you write to us and any other personal information about you that you provide.

Please note that you are under no obligation to provide your details, unless you agree to do so, but if you choose to submit personal information, they must be correct, accurate and complete. Providing false information may prevent you from the possibility of using the Site, and may prevent us from responding to you.

2. Information Collected During Your Use of the Site

The Site uses third-party tools to collect and statistically analyze anonymous information – which is not identified with you personally – regarding your use of the Site. While you are using the Site, the following information may be collected: information about your computer, including your IP address, the type of browser you use and its version, and the operating system; information about your visits and use of the Site, including the source of reference, the length of visit, page views, and the path in the Site; information created during the use of the Site, including when, how much and in what circumstances you use the Site.

3. Use of Your Personal Details

Personal details provided to us will be maintained securely in our database, and will be used for the following purposes:

3.1 Administration of the Site and to enable you to use the services it provided;

3.2 For analysis, control and provision of statistical information to third parties. Such information will not identify you personally;

3.3 For any other purpose detailed in this policy or in the Terms of Use;

3.4 In order to send you, from time to time, updates by email or text messages (SMS) regarding the Amuta’s activities, requests for donations and other publicity materials (you may notify us at any time that there is no need to send updates);

3.5 In order to contact you as needed, or in response to your turning to us.

4. Sharing Information With Third Parties

We will not share your personal information with third parties without your express consent, except in the following circumstances:

4.1 In order to comply with legal or regulatory requirements, we may share your information if required to by law, pursuant to the instructions of an authorized body or court.

4.2 External suppliers- We may share your information with outside service suppliers who assist us in our activities such as: IT suppliers, financial clearing services for donations, support and storage suppliers (including cloud storage), suppliers of data analysis and those used to send publicity, various other consultants, etc. Such outside suppliers only receive access to information for the purpose of providing their services to the Amtua.

4.3 In case of legal dispute between you and the Amuta.

4.4 To entities connected to the Amuta or who cooperate with us, who will use such information only pursuant to this privacy policy.

4.5 Should we change our legal structure, we will transfer copies of the personal information collected in our databases to the relevant entities, provided they act pursuant to this privacy policy.

4.6 For purposes of testimony and documentation projects – pursuant to this privacy policy and your signed agreements.

5. For Your Information

You are entitled to review the information collected pursuant to this privacy policy, according to the Israeli Law for the Protection of Privacy, 5741 – 1981 (hereinafter: “the Law for the Protection of Privacy”). Furthermore, you are entitled under the Law for the Protection of Privacy, to ask in writing that the information about you be amended or deleted from the database, subject to law. Please note that your above right to access, delete or amend, may be limited. If we are unable to accede to your request, we will notify you in the manner determined by law.

6. Cookies

A “cookie” is information implanted automatically in the hard disk of your computer when you visit certain websites. A cookie may be able to identify your particular web browser and server. The Amuta uses cookies in order to enable the ongoing and proper maintenance of the Site, including for the collection of statistical information about use of the Site, confirming details, to adjust the Site to the personal preferences of the users, for data protection purposes, and in order to avoid the need to input user details in various areas of the Site.

If you wish not to receive cookies, you may prevent that by changing the settings on your browser. To do so you need to use the browser’s “Help” file. Furthermore, you may delete the cookies from your computer at any time. Please note that disabling the cookies or preventing the ability to receive them may affect your use of the Site.

The Amuta is committed to ensuring that your information is safe and protected. In order to prevent access to personal details, the Amuta operates in accordance with physical, electronic and administrative procedures to protect the data it collects. Still, while the steps we take lower the risks of hacking or unauthorized use of the data, they cannot guarantee complete security. The Amuta will not be responsible for any damage of any kind, direct or indirect, which may be caused to the user if information is lost and/or if unauthorized use is made of it. If you do not agree to this, do not use the Site.

8. Changes in Terms of Use and Privacy Policy

The Amuta is entitled to change its terms of use and privacy policy from time to time. If material changes are made, such as with regard to the use we may make of information you provide, notice will be published on the Site.
